A Cranbrook, B.C., teenager is dead but his young killer will not be charged.

Cranbrook RCMP say the boy who fired a fatal shot last Thursday is just 10 years old, and charges cannot be laid against anyone under the age of 12.

Seventeen year-old Michael Justin Voth died when he was hit in what police say was an accidental shooting as the 10-year-old picked up a loaded shotgun in the southeastern B.C. town of Jaffray, near Cranbrook.

Mounties say the owner of the shotgun could face charges linked to insecure storage of a firearm.

An investigation is continuing and charges are expected to be forwarded to Crown, although there is no word when that may occur.

Police say no adults were home but several young people were in a Jaffray house on June 16 when the tragedy occurred.
