A five-year-old B.C. girl killed by a drunk driver was heard singing Christmas songs in a video played in court Monday at the sentencing hearing of the driver.
The Christmas pageant video of Alexa Middelaer was played by her father Michael as part of his victim impact statement.
He told the court Alexa was his "dear sweet daughter," that he is now a broken and gutted soul and his family is a three-legged stool, functional but unstable.
The sentencing hearing was for Carol Berner, who was convicted of four charges, including impaired driving, in the death of Alexa along a rural road in Delta in May of 2008.
The Crown is calling for a jail term of up to five years while the defence wants two years probation with no jail time.
Provincial Court Judge Peder Gulbransen has reserved decision, saying he likely won't need more than a week to sentence Berner.
