The son of Carol Berner, the B.C. woman accused of driving while impaired in the death of four-year-old Alexa Middelaer, is awaiting trial on charges of second-degree murder.

Joshua Berner is charged in the fatal stabbing of Benjamin Warland, 23, near a Richmond bus stop on Feb. 1, 2009.

It is believed an altercation between the two men began on a transit bus and ended at the bus stop.

Warland was found lying on the lawn of a home on Cambie Road suffering from serious stab wounds around 11 p.m. He died from his injuries by the time paramedics brought him to hospital.

Berner and another Richmond man, then 24 and 25, were taken into custody after Warland's death, but were later released. Berner was charged in May last year.

His trial is expected to begin at B.C. Supreme Court in Vancouver in September.

Meanwhile, a judge is now deciding whether Carol Berner is guilty of driving while impaired. Lawyers finished presenting closing submissions Thursday afternoon.
