A B.C. court heard more details Wednesday about an extensive undercover operation in which an agent befriended Carol Berner, the woman accused of dangerous driving in the death of a four-year-old.
Berner is on trial in Surrey provincial court for impaired driving and dangerous driving in the 2008 death of Alexa Middelaer.
During a secretly videotaped discussion with an undercover officer, Berner talked about the crash.
"I was going faster than normal…. I couldn't stop the car and then I was having an anxiety attack trying to stop the car, and I couldn't," Berner told the officer.
Alexa's father Michael Middelaer says that evidence only raises more questions.
"I think the interesting piece about what she said there was that she had (the anxiety attack) after she lost control of the vehicle, and the question I always ask myself is, what caused her to lose control of the vehicle?"
That's what defence lawyers want to know, too. Berner's lawyer David Tarnow is upset that her car was destroyed before Berner was charged.
"It's very important, because Ms. Berner has indicated there was something wrong with her car. She couldn't control it. So, I wanted to have a mechanic take a look at it," Tarnow said outside the courtroom.
Alexa's family doesn't buy that argument.
"We've heard testimony already that the vehicle was checked out immediately afterwards, and there was no apparent problem with the vehicle whatsoever," mother Laurel Middelaer said.
The court also heard that Berner thought police were trying to pin the blame for the accident on her, and that she was having a tough time dealing with the stress.
But the Middelaers point out that all of this was happening while they were still mourning the death of their daughter.
"She keeps claiming that her life is a misery and full of nightmares, yet she's going to these Halloween parties and she's seemingly having a pretty good time in life," Laurel Middelaer said.
Berner's trial is scheduled to continue on Thursday.
