A B.C. Mountie has been ordered to stand trial for obstruction of justice in the fatal crash that killed a young motorcyclist three years ago.

Cpl. Benjamin "Monty" Robinson struck Orion Hutchinson with his Jeep at a Tsawwassen intersection on Oct. 25, 2008.

Instead of helping the 21-year-old, Robsinson walked home, where he said he drank two shots of vodka to calm his nerves. He returned 10 minutes later.

Robinson failed two separate police breathalyzer tests, blowing over the legal limit each time.

While Delta police recommended charges of impaired driving causing death, prosecutors say there's not enough evidence to support the charge.

The officer will stand trial on a single charge of obstruction of justice, the Criminal Justice Branch announced Wednesday.

"The available evidence does not establish to the criminal standard of proof beyond a reasonable doubt, that at the time of the collision Cpl. Robinson had a blood alcohol level over the legal limit, that his ability to operate a motor vehicle was impaired by alcohol or that he was operating his vehicle in a dangerous manner," spokesman Neil McKenzie wrote in a statement.

Robinson is scheduled to appear in court May 19.
