A Victoria police officer who is the brother of a B.C. MLA has been charged with assault after an investigation by a special prosecutor.

Sgt. George Chong was accused of assault last June after an off-duty incident, the details of which have not been released.

Special prosecutor Ian Donaldson was appointed to look into the allegations because Chong is the brother of Economic Development Minister Ida Chong.

Donaldson says in a statement released Monday that there's a substantial likelihood that Chong will be convicted of the offence and that it's in the public's interest for a prosecution to occur.

Besides reviewing the decision to lay the charge, Donaldson was to make a report to Crown counsel and give legal advice to the Saanich police department, which has taken over the investigation

Chong has been on limited administrative duties since the allegations surfaced.
