A grieving woman who has waited 13 years for a trial in the murder of her brother is outraged that she has to wait longer because of a H1N1 outbreak at a B.C. prison.

Jeanie Fraser says that Gary Johnston's murder trial has been put on hold because Johnston is one of the inmates at the North Fraser Pre-Trial Centre who has been quarantined because of a number of them have swine flu.

"Thirteen years, 4745 days today," said a tearful Jeanie Fraser, who is Vic Fraser's sister. "When are they going to give me justice, not him?"

Gary Johnston is on trial for the murder of popular trucker Vic Fraser. Fraser was stabbed nine times in the neck when he apparently interrupted a burglary at Jeannie Fraser's bungalow on March 10, 1998.

He was a prime suspect early but he was only arrested in 2009, after allegedly confessing to undercover officers.

Fraser says she's worried that the trial will be longer than the five weeks allotted at New Westminster Supreme Court, and she will have to wait much longer for a verdict.

The judge in the trial has asked that the trial reconvene on Monday, and court staff told CTV News that it's expected he'll decide what to do then.

Staff also told CTV News that Johnston's trial is not the only one affected -- trials in Vancouver and Surrey have also been impacted, the staff said, though they could not say which cases.

Four patients have been confined to one living unit at the North Fraser Pre-Trial Centre, while three inmates with symptoms are being kept in their cells and treated by medical staff.

Officials say the prison has enacted its influenza protocols, which include screening new inmates, treatment of other inmates with Tamiflu and giving staff protective equipment.

This H1N1 virus is a category that includes a number of flue viruses, including the swine flu virus that prompted widespread worry of a pandemic in 2009.

Jeannie Fraser says the delay has been difficult for the witnesses in the trial, including a retired officer who has flown in from Mexico.

Thursday is the anniversary of Fraser's death.
