The B.C. Civil Liberties Association is asking the Supreme Court of Canada to allow medical marijuana patients more choice in how they take their pot.

Under the current law they can only smoke or vapourize it.

The BCCLA has gone before the High Court to argue that banning patients from ingesting marijuana through capsules or food violates their Charter rights.

The case stems from the 2009 arrest of Victoria-based Owen Smith, who was charged under the Controlled Drugs and Substances Act with producing baked goods containing pot.
