The 35-year-old New Westminster man accused of sexually assaulting a young woman earlier this month was released from police custody Tuesday morning mainly because he has no previous criminal record.
Benjamin Palk Trussart is accused of attempting to pull a 19-year-old woman into a heavily-wooded area on Southeast Marine Drive on July 6, but was scared off after a passerby heard the struggle and intervened.
Vancouver police arrested Trussart with help from video surveillance that showed him at the 22nd Street SkyTrain Station the night of the attack.
Trussart is previously not known to police and was released because of his lack of prior convictions as well as agreeing to comply with a list of conditions.
Trussart's mother posted his $15,000 bail and offered to closely monitor him. Trussart is required to a check in with his bail supervisor and police on a weekly basis. He cannot consume any alcohol or drugs and must remain in his home from 7 p.m. to 5 a.m. until further notice.
Trussart is required to stay away from anywhere the teen may be.
His next court appearance is set for August 10.
