The Vancouver Island Health Authority confirms it is investigating claims that a doctor took a naked photo of a morbidly obese patient and sent it to at least one other staff member.

A health care professional who spoke with CTV Vancouver Island on the condition of anonymity said the patient was undergoing a procedure in the intensive care unit at Royal Jubilee Hospital when the doctor snapped a photo with his phone.

The staff member said they felt compelled to complain about the alleged incident, calling it the worst confidentiality breach they’ve witnessed in their health care career.

“These people are so vulnerable and they trust us. They’re naked – they’re literally naked -- sometimes sedated. And they’re completely vulnerable and it’s our job to protect them and take care of them,” the staff member said in an interview with CTV Vancouver Island.

Dr. John Kinahan is accused of emailing the photo to a nurse, who is also his personal trainer.

Dr. Kinahan refused to confirm or deny details to a CTV reporter, and said the fact he was being called about it was “ridiculous.”

The health authority issued a statement saying an investigation is underway into the alleged privacy breach: “The investigation is being undertaken by VIHA’s Information Stewardship, Access and Privacy Department as well as an external, independent 3rd party.”

VIHA said a similar investigation took place earlier this year in Duncan.

“The prevalence and use of devices that take pictures is becoming increasingly common. As we become aware of incidents that are breaches or potential breaches, we investigate immediately,” a spokesperson said.
