A British Columbia court has dismissed charges against one of the two Abbotsford brothers who were taken into custody last week, allegedly for their own safety.
Jonathan Bacon appeared in Abbotsford Provincial Court Friday morning to face drug and weapons charges that were laid three years ago.
But Judge Donald Gardiner ruled that police did not have the right to obtain a search warrant that enabled them to lay the charges in the first place.
The decison was greeted by shrieks of "oh yea,." that could be heard inside the courtroom
Jonathan's brothers Jarrod and Jamie are in custody awaiting a bail hearing next week on a number of weapons charges.
