One of the RCMP officers involved in Robert Dziekanski's death pleaded not guilty Tuesday to an unrelated charge of attempting to obstruct justice in connection with a fatal crash more than a year ago.

Cpl. Benjamin Monty Robinson was charged in connection with an October 2008 crash in Delta, B.C., that killed 21-year-old Orion Hutchinson.

Robinson, who was off-duty at the time of the accident and has since been suspended with pay, chose a trial by judge and jury.

The not guilty plea came the same day the B.C. Coroners Service released a report that revealed that alcohol consumption on the part of the victim, who was driving a motorcycle, was a factor in the crash.

"Toxicology analysis of Mr. Hutchinson's blood revealed a blood-alcohol level in excess of the legal limit," says coroner Mike Coleman's report, dated Jan. 20, 2010.

"Speed and alcohol intoxication on the part of Mr. Hutchinson were contributing factors."

It also says alcohol intoxication on the part of the driver of the Jeep involved in the crash with Hutchinson is believed to be a contributing factor.

Robinson's lawyer could not be reached for comment.

Delta police had recommended a charge of impaired driving causing death and dangerous driving causing death, but the B.C. Crown said last December that there wasn't sufficient evidence to prosecute either charge and Robinson was charged with obstruction.

The provincial motor vehicle branch suspended Robinson's driver's licence for 90 days following the crash, which he tried unsuccessfully to appeal.

The officer argued during that appeal in B.C. Supreme Court in March of last year that a motor vehicles adjudicator didn't properly consider his statement that he left the scene of the collision, had two shots of vodka, and then returned to the scene and failed a breathalyzer test.

Robinson was the senior officer on duty when four RCMP officers confronted Dziekanski in October 2007 at Vancouver International Airport.

One of the officers stunned Dziekanski multiple times with a Taser, and he died on the airport floor.

Robinson testified for several days at a public inquiry into the death last year, and a final report is expected later this year.
