The homeless in Victoria are celebrating a British Columbia Supreme Court ruling that struck down a bylaw that banned camping in Victoria city parks.

The court says the bylaw violates the rights of the homeless to find a place to sleep that's protected from the elements.

David Johnston, the man at the centre of the court challenge, says he's "giddy" and can't believe the decision, adding he plans to put up a tent tonight in Victoria's Beacon Hill Park.

Gary Kinser, a member of Victoria's End Homelessness Committee, describes Johnston's court win as a "David and Goliath case".

But Victoria Mayor Allan Lowe is disappointed in the decision, saying makeshift tent cities are not the answer to addressing the homeless issue and he hopes the city council backs an appeal
